Terms & Conditions

**1. Eligibility:**

1.1. The promotion is open to all customers who register to purchase an Omikron OT-60 or OT–80 Yacht at the Sanctuary Cove International Boat Show between May 22 and May 25, 2025, and complete all necessary purchase documentation.

**2. Promotion Details:**

2.1. Eligible customers will receive a free Rolex GMT-Master II (Oystersteel)(Or similar) watch upon delivery of their OT-60 or OT–80 Yacht.

2.2.   This promotion is offered solely by McD Yachts and is in no way sponsored, endorsed, administered by, or associated with Rolex or any of its affiliates (Rolex). Rolex is not a participant in or sponsor of this promotion and has no relationship or association with McD Yachts. Any and all trademarks referenced in this promotion, including but not limited to the Rolex name, are the property of their respective owners. Any references to Rolex are for descriptive purposes only and do not imply any representation, affiliation, endorsement, or authorization to, with or from McD Yachts. McD Yachts respects all trademark rights and does not intend to infringe upon any intellectual property.  

 **3. Purchase Requirements:**

3.1. To qualify for the promotion, customers must complete the purchase of an Omikron OT-60 or OT–80 Yacht at the Sanctuary Cove International Boat Show during the event dates (May 22-25, 2025).

3.2. A contract for the purchase of the yacht must be signed by the eligible customer, and all related paperwork must be completed in accordance with McD Yachts' standard sales procedures.

**4. Delivery:**

4.1. The Rolex GMT-Master II (or similar) watch will be delivered to the customer at the time of the yacht’s delivery, and only after the full purchase price of the Omikron OT-60 or OT–80 Yacht has been paid.

4.2. The customer agrees to take delivery of the yacht within a reasonable timeframe, as agreed upon with McD Yachts.

**5. Timepiece:**

5.1. If the specific model of the Rolex GMT-Master II (or similar) is unavailable at the time of delivery, McD Yachts reserves the right to substitute the Rolex GMT-Master II with a comparable luxury timepiece of equal or greater value, at their discretion.

5.2. McD Yachts is not liable for any delays or issues that may arise due to the unavailability of the Rolex GMT-Master II (or similar) or any other watch model.

5.3 McD Yachts shall not provide any warranty on the time piece. The time piece provided will be either a 2024 or 2025 model with International Rolex warranty

**6. Non-Transferability:**

6.1. The Rolex GMT-Master II watch is non-transferable and cannot be redeemed for cash or credit.

6.2. This promotion is exclusive to the individual customer named in the purchase contract and may not be transferred to any other person.

**7. Taxes and Fees:**

7.1. The customer is solely responsible for any taxes, duties, or other charges that may arise with the receipt of the Rolex GMT Master II outside the jurisdiction of New Zealand.

Note New Zealand GST will be paid on the watch by McD Yachts.

**8. General Terms:**

8.1. By participating in this promotion, customers agree to abide by all the terms and conditions listed here and any applicable laws and regulations. 

8.2. Except for any liability that cannot be excluded by law, MCD Yachts (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies), excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under MCD Yachts’  control); (b) any theft, unauthorised access or third party interference; (c) any variation in the prize; (d) any tax liability incurred by a claimant or entrant; or (e) use of a prize.

8.3. As a condition of participating in the promotion, the entrants indemnify MCD Yachts, all organisers, sponsors and all other persons and organisations associated in any way with the promotion against all claims, damages, liabilities, costs and expenses (including legal fees on a solicitor and client basis) which an entrant may incur arising out of their participation in the promotion howsoever caused.

8.4. If an entrant cannot accept the prize for any reason, that prize will be void and no compensation will be payable.  

8.5. This promotion is governed by the laws of New Zealand.
